Construction Contract Dispute — Domestic Arbitration

Challenge
A property developer faced a RM 3.8 million claim from a main contractor arising from alleged delays and variations in a residential project. Negotiations had stalled and the contractor had initiated arbitration under AIAC rules.
Approach
Warisan Legal was appointed to lead the defence. We conducted a thorough review of contractual entitlements, coordinated a quantity surveyor as expert witness, and prepared detailed counter-submissions challenging the quantum of the claim.
Outcome
The arbitral tribunal awarded significantly less than the claimed amount, with the developer's liability reduced by approximately 68% from the original claim figure. The matter concluded within 11 months of our appointment.

Challenge
Two longstanding business partners in a manufacturing joint venture had reached an irretrievable breakdown over revenue distribution and management control. Both sides wished to separate but could not agree on valuation or exit terms.
Approach
Warisan Legal facilitated a structured commercial mediation, including pre-mediation position preparation for both parties' advisors and selection of an experienced commercial mediator. We supported the clients through two full days of mediation sessions.

The parties reached a comprehensive settlement agreement covering buy-out terms, transition arrangements, and non-compete provisions. The matter resolved in five weeks from initial engagement, avoiding what would likely have been 18+ months of arbitration proceedings.

Foreign Award Enforcement — International Arbitration
Cross-Border Trade Dispute · KL High Court · Resolved January 2026
Challenge
A Taiwanese trading company had obtained a favourable SIAC arbitral award against a Malaysian buyer who had defaulted on a commodity supply agreement. The award debtor held assets in Malaysia and the client needed to enforce the award locally.
Approach
We filed an application for recognition and enforcement of the foreign award in the Malaysian High Court under the Arbitration Act 2005 (New York Convention provisions), addressing the debtor's procedural objections and marshalling the required evidentiary record.
Outcome
The High Court granted recognition of the award, allowing enforcement proceedings to proceed against the debtor's local assets. The enforcement application was completed within four months, a notably efficient timeline for this type of proceeding.
